CASE I:
Accident Details:
This accident involves an elderly couple that was involved in a single vehicle accident. The wife was driving their 1996 four door sedan, and they were returning home from the store. Her husband was a passenger in the front seat.
The driver was traveling about 40 miles per hour going straight, and traffic in front of her came to a complete stop. In an attempt to stop, the driver swerved to the right to avoid striking any vehicles in front of her. When she swerved, the vehicle struck a telephone pole head on causing major damage to the car and injuries to the driver and passenger.
Damages:
The roof was cut off and passenger was extracted from the vehicle and rushed to the hospital. The passenger remained in the hospital for 8 days then released to a rehabilitation facility. The passengers' injuries consisted of a knee contusion, 3 fractured ribs, and fractured wrist. The injured passenger had prior medical conditions due to his age, which got worse after the accident.
The accident left over 2,000 people in the area without power for over 3 hours and about 100 residents were without power until the following morning.
The damages to the telephone pole exceeded $30,000.00. The residents who were without power experienced damages to electronics such as computers, printers, televisions, microwaves, ovens, and power strips. Some people had damaged furnaces, outlets, generators, and electrical circuits. The residents who sustained damages to their personal items made claims against the insurance company totaling $70,000.00.
The auto insurance policy did not have sufficient limits to cover all of the electrical damages, therefore all electrical damage claims were pro-rated.
Value of Injury Claim:
Since it was determined that the driver was at fault, the passenger was entitled to make a bodily injury claim against his own policy. The passengers' medical bills were approximately $23,000.00, which were paid in full by the insurance company. The injured passenger received a bodily injury settlement in the amount of $20,000.00.
Insurance Company Involvement:
The insurance company completed their investigation and it was determined that the driver was at fault for failing to maintain control of the vehicle. After inspection of the vehicle, it was determined that there were no defects with the brakes and the braking system did not contribute to the accident in any way.
Conclusion:
All claims settled in less than one year. The total payout for this accident from the insurance company exceeded $150,000.00. All claims settled without any involvement from lawyers or attorneys.
