How Long Does It Take To Settle An Injury Claim?


Every injury case is different. Time to conclusion depends largely on the circumstances of the injury, the nature of the at fault party, the insurance company, the insurance adjuster and the attorneys involved. If liability is clear and the adjuster has gathered all pertinent information to conclude their investigation, you could receive a check in 2 weeks. As long as your injuries are minor and you have completely healed.

There is a wide time range for settlements, and that timeframe changes substantially if a claim escalates to an actual lawsuit. Most minor claims involving soft-tissue injuries typically settle within 1-6 months.

The clock starts ticking from the date of the accident until you are required by law to receive compensation and are forced to settle your bodily injury claim. Statute of Limitations refers to the time period within which a lawsuit must be filed. The deadline can vary, depending on the type of lawsuit. The Statute of Limitations can range from 1-6 years depending on which state the loss occurred. Failing to file a claim within the time period allotted will bar you from any type of recovery for your injuries.

There is no Statute of Limitations for minors (under the age of 18 years). Therefore, if a minor is involved in a car accident and is injured, they can pursue legal action when they turn 18. If a minor is injured or harmed in an automobile accident, their legal guardians can also collect on their behalf.

Once a settlement amount has been reached, your settlement is full and final and you must sign a release form in exchange for the settlement check. At no time will the insurance company issue a settlement check without your signature releasing their driver for any potential future claims against them.
